>> kimberly: that is a wrap. that is it for us. watch for special preview edition of "the five" at #:00 eastern this sunday. >> bret: new documents from state department reveal how concerned the ambassador to libya was about the security and washington kept ignoring him. up until his murder. this is "special report." >> bret: good evening. i'm bret baier. hours before the murder, chrissteins wrote a cable to his bosses at the state department, reiterating months of previous cables that security in benghazi and libya in general spiraling out of control. from several of more than 150 pages of official state department documents released

today. as part of an expansive house investigation. james rosen has the latest. good evening. >> good evening. although the documents were written in the usual bureaucratic style of diplomats and security officers they take on the added poignancy. impact on read they're ranges from saddening to chilling. >> on the day he died, september 11, u.s. ambassador to libya, chrissteins signed a three-page cable labeled "sensitive" where he alerted the state department and other agencies to deal with growing problems in security in benghazi. lamenting that the security forces were too weak to keep the country secure. >> i'm stunned by the documents. i figured there were some documents. had no idea it would be like this. if i were the press secretary now i'd be chagrined to say the least. >> the warnings crescendo over three months' time. on june 25, he signed another sensitive cable where he cataloged what he called increase in violent attacks against western interest.

including the use of the i.e.d. against the benghazi consulate that month. islamist extremist appears to be on the rise adding the al-qaeda flag has been spotted several times flying over government buildings and training facilities. >> the committee will come to order. >> 166 pages of internal state department papers released by two republican lawmakers. congressman darrell issa of california and jason chaffitz of utah. the regional security officer told a hearing that the request for more security in benghazi were rebuffed by the state department. one memo from february of this year noted easy access that the militia enjoyed to military grade weapons, like rpgs. he noted the heavy weapons and the vehicle mountain weapons. these were the weapons used to kill stevens and three other americans on 9/11.

>> the fall of gaddafi after four decades of authoritarian rule led to disbursal of tens of thousands of small and heavy weapons and lawlessness. al-qaeda affiliated group, including al-qaeda in the aqim and other extremist groups are likely to take advantage of the ongoing political turmoil in libya. he added the u.s. government remained concern such individuals and groups may use libya as platform from which to conduct attacks in the region. >> there are two aspects to look at. one leading up to the attack. or a cover up or gross incompetence following it. >> state department spokesman told me the secretary of state will fully address these matters only after the department interim review board has submitted its findings on benghazi.

congressman cummings of maryland lashed out at chairman issa accusing issa of promoting the most negative and distorted view. >> bret: joinbe me later tonight for a special investigation, death and deceit in benghazi. you can see it at 10:00 p.m. eastern. friday night. of course you might have to set the dvr. worth checking out. there is rubblings they are getting syrian opposition and they are believed to be islamist extremists as well. is the u.s. insisting with the transfer in any way. catherine herridge tells us how syria may if it in with the assault on the american mission in benghazi.

>> the mysterious ship may be linked to the 9/11 terror attack in the u.s. consulate in benghazi. using the ship records, fox news confirmed the victory received on september 6. this is five days before ambassador stevens and sean smith and former seal tyrone woods and glen doherty killed in an extended terrorist assault by 125 members of the militia. on the night of the attack in benghazi, ambassador stevens just finished dinner with a turkish diplomat. according to that initial september 14 report by the times of london, 400-tons of cargo was on board. some humanitarians but also the largest consignment of weapons headed for syrian rebels on the front line. >> this is a ship by the name of victory carrying weapons that are found in libya. >> he is a middle east and terrorism expert for fox news.

>> the ship came that way, all the way up to extend it in turkey. s. >> now the information available there were weapons. a lot of weapons. >> it included surface to air antiaircraft missiles like these. rpgs. russian designed man portable air defense systems known as man-pad. the ship captain told "times of london" "i can only talk about the medicine and humanitarian aid for rebels." there was a report about fight for the weapons and what got what, between the free syrian army and muslim brotherhood. >> what has been happening in the past few months and a year is arab spring that went wrong in libya. >> the free syrian army now has al-qaeda militias in their ranks fighting to out president assad. to date, more than 32,000 people have been killed there.

you are looking at what happens when the arab spring turns in to a radical islamist winter. >> weapon systems are extremely accurate and with a short amount of instruction, you have somebody capable of taking down any aircraft. anywhere in the world. >> muammar gaddafi, the former libyan dictator owned more man-pads than anyone else. >> today, neighbor announced death of muammar gaddafi. >> quickly, the u.s. committed $40 million to help the new libya find the gaddafi stock pile. in february, the assistant secretary of state for political and military affairs shapiro expressed concerns about missing man-pad. >> how many are still missing? we don't know and probably never will. >> porter goss is former director of the c.i.a. >> do you think we'll find out some of the weapons from libya

made their way to syria? >> absolutely. >> there was testimony about the threat from loose weapons. >> figures we were provided were rough estimate. >> effort to get the 7s out of the hands of extremists. asked to comment, spokesperson dismissed the idea saying stevens was there for the diplomatic meeting and attend opening of cultural center. >> bret: more on this in the 10:00 p.m. special. thank you. the white house and u.n. security council are condemning today's terrorist car bombing in beirut, lebanon that killed a senior intelligence official and seven others. lebanon opposition party is holding the prime minister responsible for and calle callig for his government to resign.

they are trying to make sure the new constitution represents all factions of society. the 100-member assembly writing the document is loaded with islamists. back in this country, survivors of the 2009 fort hood shootings and relatives of those killed want the government to declare the incident terrorist attack. they released a video to make their point. terrorism designation would allow people affected to receive the same benefit of those involved in combat. workplace violence is not a muslim, jihadist terrorist. and camouflage by wearing u.s. army military uniforms. opening fire, unarmed, unprotected soldiers. >> bret: major hasan is charged with 13 counts of premeditated murder. something new on the front page of the america newspaper

from the house oversight committee. some of them written by the late ambassador chris stevens. start back in june. this is a few months before his death. writing that islamic extremist appears to be on the rise in eastern libya. the al-qaeda flag spotted several times flying over government buildings and training facilities. the government of libya until they are able to effectively deal with the key issues the violence is likely to continue and worsen. august 8, month before his death, benghazi moved from trepidation to euphoria and back. as a series of violent incident dominated the political landscape. the individual incidents have been organized. islamist extremist are able to attack the red cross with relative immunity. we have seen not the random crimes of opportunity but targeted and discriminated attack. attackers are unlikely to be deterred until authorities are as capable and then on september 11, just hours

before he's murdered, he writes that there are growing problems with security. there are growing frustration with the libyan security forces. that they are unable to keep the country secure. that they are too week to keep libya secure. again, he would be murdered hours after signing the last cable. bring in the panel. steve hayes, senior writer for the "weekly standard." kirsten powers for daily beast. syndicated columnist krauthammer. steve? >> three major developments in the last 24 hours. you just laid out one of them with the cables directly from ambassador stevens, including the one on september 11, itself. the station chief wrote a cable immediately saying this was a planned attack. there were al-qaeda links. this was not something that arose out of a spontaneous protest because of a video. >> bret: let me interrupt you. fox reported on septembe septem,

intelligence officials telling us that the intelligence community sending up the chain from libya, they were saying terrorist attack and tied to al-qaeda. they were on the hunt for al-qaeda. >> an there was no protest. this report ads the cable came from station chief. if you were going to find out what happened the first person you contact the c.i.a. station chief in country to give you a read on what happened. third thing, the "new york times" piece you reported on, qatala a leader in libya, seen at the compound. directing the fighting in the compound that evening and acknowledging having been in the compound.

that is extraordinary. after 38 days on day 38, we have so many more questions about what happened in libya. despite the claim to jon stewart the late night comedian we have a president encouraging more questions. not answering the ones already posed. >> it's incredible after everything you went through to remember it was just a movie. looking at the cable he said it's not random crime of opportunity happening here. and that they have all of this information. and know this. and yet still come out to make the claim. this was all the spontaneous protest by movie.

i spent time talking to people in the administration. basically saying you can't trust that. they have been saying it's not true. they won't go on the record now. we have a story confirming it. >> it refutes the president's claim on a comedy show when they got any piece of information, they laid it out to the american people. we now know that administration got report from the station chief in libya, saying it was terror attack. ple planned attack. she not only isn't sharing that, she is contradicting it. there is no evidence it was preplanned attack. every level, you think back to what the president said.

in the second debate, he was offended that governor would imply, suggest that anybody in his administration had misled the country on libya. misleading is at so many levels, so many contradictio contradictions. hiding of information. covering of information it's almost enumerable. i think romney has a tremendous opening on monday. the number of statements misleading is staggering. for them to proclaim they lay out the information and offended by the implication they misled, the president himself was saying on letterman a week after the attack, that it was, had to do with the video. time when everybody knew. nothing to do with the video. >> bret: i should point out the administration stopped talking about this.

the state department said an independent board is conducting thorough review of the assault on the post in benghazi. once we have the board comprehensive account of what happened. findings and recommendations we can address the matters. >> that contradicts that the president said. who is in charge here in the president is saying we want to put every piece of information out to be responsive and answer questions. the state department should answer the question. >> one other aspect, you know when the report will be completed? >> november 7. >> november 15, middle of the month. it's an attempt, you simply say there is an inquiry happening and we can't speak about it. that insulates them. even the main stream media, i mean even now can't hide from this issue. the other story quickly. the libyan ship gets to syria. it's carrying cargo that includes weapons.
